Karin Law: sick leave and annual leave do not suspend investigations

Ruling No. 486 requires proceedings to continue while protecting the right to a defence.

Administrative ruling: Labour Directorate Ruling No. 486 of 22 October 2026. Applies existing guidance.

The development

The Labour Directorate clarified that sick leave, annual leave or similar absences of those involved do not suspend investigations into sexual harassment, workplace harassment or third-party violence.

The investigator must balance promptness with due process: assess each situation and determine the investigative steps, their timing and the appropriate channel, while respecting employment rights.

Practical significance

Internal protocols should be reviewed and decisions about interviews and other steps documented. Continuation of the procedure must allow the parties to be heard and substantiate their statements.
