Karin Law in municipal healthcare: procedure and review of disciplinary investigations

Rulings Nos. 489 and 490 clarify the rules for staff governed by Law No. 19,378 in municipal corporations.

Administrative case law: Labour Directorate Rulings Nos. 489 and 490 of 22 and 23 October 2026. Apply existing guidance.

The development

Ruling No. 489 clarifies that complaints of harassment or violence involving municipal primary healthcare staff must be investigated under Law No. 18,883. The investigation rules in the Labour Code and Decree No. 21 of 2024 do not replace that procedure.

In the disciplinary investigation, the investigating officer must adopt immediate protective measures, including in relation to a trade union official, considering proportionality and protection of the union role.

Ruling No. 490 reiterates that the Labour Directorate does not review irregularities in unfinished disciplinary investigations in municipal corporations. Its subsequent review is limited to formal legality and does not allow re-examination of facts or annulment of the final administrative act.

Practical significance

Before starting or challenging an investigation, the applicable legal framework and review route should be identified. Using the wrong procedure may compromise the validity of the proceedings.
